I was camping at Sun Lakes State Park and rode a friends small scooter to the store on the same Property. The Ranger stopped me as I was heading back (ironically) to get my wallet and wrote me a criminal citation under RCW 46.20.005. My license was less than 100 yards away and I told him I would walk and get it and also tried to tell him my license number (I know it verbatim). He told me it wasn't necessary and gave me the ticket. Because I have a valid license just forgot my wallet, shouldn't it be written under RCW 46.20.015? I have a job that is dependent on a clean criminal record.

If you did not have any valid identification on you at the time, no valid operators license on person in the first degree would be the appropriate charge. This is a misdemeanor. I would get an attorney to help you on this. This is usually a situation where an attorney can help you keep a clean record.

I have to disagree with Mr. Lawrence. I believe the correct citation would be RCW 46.20.017 - immediate possession and display on demand. Both RCW 46.20.005 and 46.20.015 presume that you have no valid license. It sounds to me like you are validly licensed, you just didn't have it on your person. That falls under RCW 46.20.017, which is a nonmoving violation. Hire an attorney to clear this mess up in court.

I would seek an attorney. RCW 46.20.005 refers to not having a license in your possession. It does not say on person. RCW 46.20.017 reads as follows: 'Every licensee shall have his or her driver's license in his or her immediate possession at all times when operating a motor vehicle and shall display the same upon demand to any police officer or to any other person when and if required by law to do so. The offense described in this section is a nonmoving offense.' There is a distinction between possession and 'immediate possession.' There should be options for you that do not involve a conviction. Speak with a lawyer.
